1. How much cannabis can an individual possess, use, or transport?

• Possess or transport up to 2 ounces of cannabis flower in a public area.
• Possess up to 2 pounds of cannabis flower in a person’s private residence.
• Possess or transport edible cannabis products or lower potency hemp edibles infused with a combined 800 milligrams or less of THC.
• Give away cannabis flower and products to a person 21 or older in an amount legal for a person to possess in public.
• Use, possess, or transport cannabis paraphernalia.

2. Can I grow/cultivate cannabis at home in Red Wing?

• Yes, but is limited to up to eight cannabis plants, with no more than four being mature, flowering plants being grown at a single residence, if it is the primary residence of someone 21 or older.
• Plants must be in an enclosed, locked space that is not open for public view.
• Unlicensed sales are not allowed

3. Where can cannabis be consumed in Red Wing by people 21 and older?

• On private property (unless prohibited by the owner of the property).
• Private residences including a curtilage (the enclosed area surrounding a house or dwelling) or yard.
• Places with approved licenses or an event licensed by the state to permit on-site consumption (no licenses or events permits are available at this time).

4. Where is it illegal to consume cannabis in Red Wing?

• Cannabis can not be used when operating a motor vehicle or operating heavy machinery. Driving under the influence of cannabis is illegal and subject to additional DWI sanctions.
• Any public place or public property generally accessible to the public such as city parks, city streets, city sidewalks, parking lots, sporting events, trails, pathways, etc.
• The MN Clean Air Act prohibits the use of cannabis anywhere smoking and vaping is also prohibited.
• Cannabis can not be possessed or used in a public school, charter school, school bus, state correctional facility, federal property, federally subsidized housing, or while on an employer’s premises, or operating an employer’s vehicle, machinery or equipment.
• In a location where the smoke, aerosol or vapor could be inhaled by a minor.
• Smoking or vaping adult-use cannabis products is prohibited in multi-family housing buildings, including patios and balconies. OCM can assess a fine if there is clear evidence showing a person has violated Minnesota Statues, section 342.56m subd. 1(b). See complaint section.
• Violations of these guidelines are considered a petty misdemeanor.
• The City of Red Wing adopted Ordinance No. 210 on April 8, 2024, regarding the use of cannabis and hemp products in public. See section 10.29 of City Code.

5. Are licensed cannabis sales allowed in Red Wing?

• Licensed cannabis sales in Red Wing are not allowed until 2025. Per state law, all licenses will be issued by the Minnesota Office of Cannabis Management (OCM), not the City of Red Wing.  
• The exact timeline for general licensing to begin depends on the rulemaking process, but OCM is anticipating the adoption of rules in early 2025.
• When licensing begins in 2025, OCM will vet applicants and proceed through the verification process. At that time, OCM will be required to receive certification from the City of Red Wing that the business meets local zoning ordinance requirements and/or local registration requirements before operations may commence.  
• Unlicensed sales are not allowed.

6. What authority or role does the City have in regulating cannabis businesses?

• The City may not prohibit the possession, transportation, or use of cannabis, or the establishment or operation of a cannabis business licensed under state law, but they can adopt reasonable restrictions on the time, place, and manner of a cannabis business.  This means we can restrict the hours of operation, require buffer zones for schools, daycares, treatment facilities, and attractions in a public park regularly used by minors per Minnesota Statute 342.13.  
• The City is currently working on developing, amending and adopting ordinances related to zoning and registration of cannabis businesses in Red Wing.
• The City will have the opportunity to place a limit on the number of retailers and micro and mezzobusinesses with retail endorsements allowed to operate in Red Wing, if they wish to do so. This limit will be based on Minnesota Statute 342.13.
• Local governments are permitted specific authorities for registration refusal and registration suspension, in addition to and not in conflict with OCM authorities per Minnesota Statute 342.22.
• The City must conduct compliance checks, with age verification, for cannabis and hemp businesses holding retail registrations at least once per calendar year.
