What authority or role does the City have in regulating cannabis businesses?
  • The City may not prohibit the possession, transportation, or use of cannabis, or the establishment or operation of a cannabis business licensed under state law, but they can adopt reasonable restrictions on the time, place, and manner of a cannabis business.  This means we can restrict the hours of operation, require buffer zones for schools, daycares, treatment facilities, and attractions in a public park regularly used by minors per Minnesota Statute 342.13.  
  • The City is currently working on developing, amending and adopting ordinances related to zoning and registration of cannabis businesses in Red Wing.
  • The City will have the opportunity to place a limit on the number of retailers and micro and mezzobusinesses with retail endorsements allowed to operate in Red Wing, if they wish to do so. This limit will be based on Minnesota Statute 342.13.
  • Local governments are permitted specific authorities for registration refusal and registration suspension, in addition to and not in conflict with OCM authorities per Minnesota Statute 342.22.
  • The City must conduct compliance checks, with age verification, for cannabis and hemp businesses holding retail registrations at least once per calendar year.
